    “Thirdly, and perhaps most importantly, it is a complete myth that the financial crisis—and especially the problem of excessive bank leverage and risk-taking—was a purely “Anglo-Saxon” phenomenon. The reality (of which most Germans I meet seem to be oblivious) is that, on average, German banks were more highly leveraged than American banks. Indeed, according to calculations published last year by the New York Times, German banks were the most leveraged of all developed country banks..

    Although national definitions vary, the newspaper suggested that the average ratio of assets to capital for American banks was 12 to 1. For British banks it was 24 to 1. For Belgian banks it was 33 to 1. But for German banks it was a staggering 52 to 1. This reflects the fact that German regulators appear to have taken an exceptionally relaxed view of bank capital adequacy, more or less uncritically applying the Basel accords.

    Under the Basel I rules, agreed in 1988, assets of banks are divided into five categories according to credit risk, with risk weights ranging from zero (for example, home country government bonds) to 100 per cent (corporate debt). International banks are required to hold capital equal to 8 per cent of their risk-weighted assets. Basel II, first published in 2004 but only gradually being adopted around the world, sets out more complex rules, distinguishing between credit risk, operational risk and market risk, the last of which mandates the use of Value at Risk (VaR) models, which calculate the likely exposure of a bank to losses on the basis of date from a relatively short time-period (e.g. the last two or three years). Liquidity risk is combined with other risks under the heading “residual risk”.

    The lesson of the crisis is that the more countries followed these rules, the more vulnerable their banks became. First, risk-weighting assets ceased to be a meaningful exercise when rating agencies conferred Triple-A ratings (the highest possible score) on no fewer than 64,000 structured financial products such as Mortgage Backed Securities (MBS) and Collateralized Debt Obligations (CDOs). These securities mainly originated in the U.S. and were often based on subprime mortgages. Bundled together, with their revenue streams divided into three different tranches, these lousy loans were transformed by financial alchemy from lead into gold, combining Triple-A ratings with higher returns than equivalently rated government bonds. German banks were among the most eager buyers of this fool’s gold…

    For all these reasons, European banks—and especially German banks—are in fact in a worse position than their American counterparts. Fact: EU banks have combined assets of around 330 per cent of their GDP, compared to U.S. banking assets of 50 per cent. Fact: EU banks have approximately 75 per cent as much exposure to U.S.-originated “toxic assets” as American banks. Fact: The German government estimates that there are toxic assets with a nominal value of over $1 trillion (€800bn) on the balance sheets of German banks. Only a lack of pressure from national regulators and a lack of scrutiny by investors has postponed (and I emphasize the word “postponed”) the day of reckoning. But that day is now fast approaching.”

The Intl bankers reluctantly had no choice but to reveal themselves in the bail out situation which has resulted in a massive questioning by the public as to how we have been conned for a very long time. The general public for the first time are beginning to understand just how much we have all been conned and how big the lies have been!     The question remains: when California Doc made mention of habeus corpus: he was questioning the right of the corporation to be represented as individual in US courts. If the Federal courts are operating under the system of admiralty law, then the individual who accepts the contractual federal agreements of licensure would not be a party to the body. We are chattel: we are not the body.

    The Federal courts enforce Admiralty Law, and the original Admiralty Courts that existed as a hang-over from British Law were placed under jurisdiction of the Federal courts by the Judiciary Act but even then State courts can take precedence ( I believe if the matter is local to a single state). Admiralty law is very much separate from civil and common law and only applies to things related to boats and navigation and shipping and the things that you’d expect. Not much to do with Washington DC that I can see.

    Since the Congress determined that bankruptcy proceedings are in federal court, the federal bankruptcy trustees would need to execute work or court decisions on any bankrupt company or individual.

    Federal courts certainly hear cases related to interstate commerce and disputes or offenses against US federal law.

    The odd thing is watching a state like California legalize marijuana in direct violation of federal law. The Los Angeles city council is deciding this morning on the placement of marijuana distribution “clinics”. These are essentially legalized pot sellers. There is not a better example of the dissonance in American government than the utter and total disregard for federal legal statutes in California marijuana clinics.

    Not only are these “clinics” in violation of State of California business and corporate code, but these “clinics” are in total violation of federal drug laws. Yet, the cities must make sales taxes off these “clinics” and therefore permit it.

    What good are these courts under any framework when there is utter and total chaos in the enforcement of corporate conduct.

    The entire point of this blog appears to shed light on the horrible corporate abuses which are present and the utter failure of the US government to hold accountable the financial institutions which sacrificed main street for personal gain.

    The professor at Univ of Boulder in part 8 of 8 made a startling but clear comment about the math in our society in the United States.

    As the population grows, the system of government becomes more unstable. Since there are limits on the number of Congressional representatives, the House and Senate become more and more distant from the people BECAUSE of population growth.

    Even when you account for technological change and information systems, you can not have a functioning direct democracy where your vote is diluted by substantial amounts over a few years time.

    For instance, if your district had 10,000 people in it 20 years ago and now has 40,000; you lost 75% of your relative strength in the political process.

    Now, with the corporate buy-out approved by the Supreme Court, our voices are all but extinguished.

    One consideration would be to translate these concepts into a modern Declaration of Independence from the people to Washington

    The stamp act and courts you’re talking about are British courts and British laws, and it seems that giving British Admiralty Courts jurisdiction over Stamp Act prosecutions was pretty much a power grab, but in any event this all preceded the Declaration of Independence, much less the US Constitution. The Constitution is clear that the Admiralty Law in the US is (and has been for over 200 years) the purview of the Federal Courts.

    You’re right… paying your taxes is voluntary. Like any voluntary choice it comes with consequences. In the US, the consequences of exercising your voluntary choice to not pay the taxes that the Government’s Collection Agency (the IRS) says you owe are, seizure of your property, and possibly putting you in a cage. All very pleasant stuff. I don’t like it either.

    But the people that create stories about how somehow having your name all in capitals, and making claims under Admiralty Law, and UCC filing affect your legal requirement to pay those taxes are making unsupportable claims as far as I can tell. Again, if the claims are supportable, just present some evidence.

    The author says:

    Unfortunately he doesn’t. Not even one citation.

    Later he says:

Question to anybody…been following Max & Stacy for a few months trying to understand the financial mess but I need to understand this…if someone can go in and create a financial instrument “of mass destruction” why can’t someone go in and come up with an algorithm and create the opposite…afterall it’s all virtual money right? In the past, I’ve read articles in the news where hackers are able to hack into bank accounts and steal the interest accumilated each day…I guess what I’m getting at is why aren’t there other creative alternatives out there to help fix or undo the financial mess since our politicians aren’t going to do something.     What you were talking about is akin to how the colonies revolted against Britain.

    They fought gurilla style because they knew they could not win conventionally. If they lined up face to face with the British they would get slaughtered.

    So I guess that is what we have to do find some sort or ingenius way to fight this. I think Max has been pushing this.

    There are two possible solutions as I see it.
    1. Convince everyone of what is truly going on and also convince them to drop out of the “system”, basically stop propping up and protecting the racket.
    2. Fight dirty gurilla warfare whether it be tech based or otherwise.

    For you personally I would forget the tech thing. There has got to be a talent you can bring to fighting this global tyranny.

  319. People are looking for an economic solution to what is a criminal conspiracy which can only be eradicated either through politics/revolution. The New World Order is just another manifestation of what has been around since mankind changed from a hunter gather to owning land which in turn required defending by strongmen who then fleeced the landowners slightly less than the bandits who would steal and kill them if the strongmen were not around. We are just at the end of a super cycle which hopefully will lead to massive change, however whether good or bad???

    It’s not about “dropping out of the system.”

    It’s about finding ways to leverage “us” and screw “them”.

    “They” (i.e. wall street racketeers) have been screwing “us” (i.e. middle class honest investors).

    We can screw up the racket by withdrawing participation.

    At this point, the ways to withdraw participation are the following:
    1. Grow your own food
    2. Trade with neighbors (barter), but neighbors aren’t trading enough yet..they’re still drinking merlot (salute to Johngaltfla.com)
    3. Decouple from the Federal Reserve Note (buy silver Eagles or Gold Eagles or other similar bullion coins)
    4. Put up renewable energy generation and use it.
