Because by law they have to pay into the Federal Government for Education and they want their tax payer money back.
This is an old battle – and it always starts and ends with underfunded Congressional Mandates.
The history dates back to JFK’s “Panel on Mental Retardation.” At that time and with all the best of intentions reforms were needed all around.
We began to feel the costs of these reforms when they were put into practice with the Rehabilitation Act of 1973 (aka section 504), a civil rights issue; people with disabilities were now able to integrate into everyday society. This dates back to Richard Nixon; Executive Order 11776 – Deinstitutionalization. A whole topic in itself.
Later – Individuals with Disabilities Educational Act (IDEA) 1975.
Over time each president expanded the laws and Congress the costs. In 1990 Bush41 enacted the Americans with Disabilities Act (ADA) which came into maturity under Bill Clinton.
All these expansion were very noble ideas, mandates and laws; certainly long over due, but Congress never fully funded them and Federal Law forces states to stay within the law, which means if the Feds don’t fund the programs the states must pay for them in order to stay within the law. That means raising state or city taxes to cover those costs.
People often get upset that we shell out such and such per student in education and yet the results get worse and worse every year. What they don’t take into account are these underfunded Congressional Mandates.
In order not to break the federal law states must make up the difference Congress doesn’t fund or risk fines, fees and money state pay to the Feds lost for education altogether.
Here’s a very basic example:
A State or District says it costs $10,000 a year to education a child. That’s before breaking down the numbers.
A regular student, or what they used to call a normal child, costs about $2500 a year to educate (you can often see the true costs if your state allocates money for Choice Schools and sometimes Charter Schools). The cost to educate a child has not really gone up, that’s about what it cost to educate a student back in the 1970s.
A good chunk of the remainder is paying for the underfunded mandates which are the costs for children with disabilities. Some children can cost the state up to a million dollars a year. But remember these are children, pre-JFK and Nixon, who were thrown into rat, roach and disease infested institutions prior. A shameful period in any nation’s history.
Add- In the 90′s Least Restrictive Environment (LRE) was put into practice. That has forced states to pay for private education on top of other services as part of the Disabilities Act.
Then add the growing requirements to the profession for special education.
It’s not only the students themselves that cost more, there’s the transportation costs, the higher costs of special education teachers and a whole range of specialists.
Here are few more numbers.
Again, depends on the state and district per year –
Regular class teacher $30k
Special Ed teacher $60k
A Number of Specialist – speech, hearing, blind, social workers, counselors, occupational therapists, psychologists, recreation, ESL, behavior specialists, SE assistants and testing.
Costs range for these professionals, $60K to $150k a year each. Again this depends on the state and the degrees these professionals have.
Bottom line is special education just costs more and by law citizens have to pay for it.
And I’m not even touching on the costs poverty has on the system.
However, the law does provide for some checks and balances. Again depending on the state, districts are told to cap special education somewhere between 14% and 20%. If they go over the district’s policy or states legislative number there are more costs involved to investigate each additional case and then the costs to increase those number.
Schools do not like to break down these costs because they often cause fights among parents, administration, teachers and taxpatyers. Also, depending how one presents these numbers to the public this topic can get school members in trouble with the law.
This is probably more than you wanted to know and it’s far more complicated then what I’ve presented here, but as far as Wyoming’s concerned they, like all other states, want their share of the money back.
Let me throw one more fight into the mix. If you live in NYC you pay more to the Federal Government than those who live in Wyoming.
Logic dictates you have more people thus you send in more money, but if you live in NYC your state doesn’t get the equal amount you paid into the government in educational dollars. In essence NY Educational dollars are actually supporting Wyoming’s educational system.
If you lived in Wyoming why wouldn’t you keep taking money offered by the FED, as far as your concerned tax payer dollars are tax payer dollars.
NY could sue, but after the costs of lawyer fees, and you’d have to sue every states, it’s not worth it.
This way the system works is a bureaucrats dream come true.

That Canadian retirement Fund piece fails to recognize a defined benefit structure. They have overpromised with false economic assumptions. An nonsustaining construct paying out a disproportionate amount to current retirees. Usually when the numbers are crunched they earn far more from retirement than their contribution would warrant. Our most emminent danger is from our medical industry. We can debate endlessly about cap and trade, how many miles are on your car, the peak oil and continue to harm to the environment. But we KNOW our doctors are harming millions with the inevitable lying commercials, while we protect them with law after law after law (and while we piss “miracle” drugs into our drinking water). Where is the protection for the end user?
And please, don’t say the “health” care legislation was “protection”. Nothing could be further from the truth. Unlike the people that are starting to rise up against the financial terror (good thing), most are now FORCED to get medical intervention – for “their own good”, with no one that has the power, will or intelligence to fight that economically disenfranchising, slow, cruel and mandated death.
